Introduction

Use of Californila (herein referred to as the "Website") is governed by these terms and conditions ("Terms and Conditions"). Ishkaster Inc. (herein referred to as "company", "we", "us", or "our") is a duly registered Philippine-based company engaged in the business of providing marketing solutions and logistics to persons, partnerships, corporations, associations, and entities situated at  The One Executive Office Building Unit 103, Ground Floor # 5, West Ave., Corner Col. Martinez St., Quezon City, 1104, Philippines.

The User (herein known as "Users", "Client", "They", "Customer", "Customers") who has agreed to become a member of the Website by providing registration data (referred to as the "Email Address", "Password", or "Registration Data") Each user has designated a unique identification (email address and password) and thus accepts the terms and conditions delineated hereunder.
By accepting these Terms and Conditions, the User has accepted and agreed to be bound by the policies outlined in the following policies:

Creating Account

To create an account with Californila the user must be 18 years old and above with a valid email address. Your personal information such as Name, Birthday, and Contact Number must be correct. It will be used for the whole process of our service. We have the right to request additional documents to make sure that all information added is complete and correct.

It is the sole responsibility of the user to maintain the confidentiality of the account. The user should not share personal information with another person. Users can change the password anytime to avoid a security breach.

The company has the right to remove, delete or terminate the account.

Account Termination

Users can request or terminate the account at any time by simply informing us. Terminated accounts will no longer be available, and if the user wishes to use our service, they need to create a new account and follow the procedure.

The company has the right to remove, delete, or terminate the account for any reason, with or without prior notice or explanation and without liability.

Users may use our shipping calculator to get an estimated amount and this may change for the following reasons: the difference between the product's dimensions and weight and its actual dimensions and weight; and exchange rates.

Payment

Users authorize us to charge their preferred payment method. These charges may include handling fees, credit card fees, shipping fees, storage fees, and incoming duty or tax charges.

Prohibited Items

If the item is part of our prohibited items and products are classified as hazardous, dangerous, prohibited, or restricted, it will be returned to the merchant at the user's cost, and/or we reserve the right to dispose of the item.

The company will not ship items that are hazardous, dangerous, prohibited, or restricted by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), any applicable government department, or other relevant organization.

The company has the right to open the package and inspect the received items for damage, security purposes, and to make sure they comply with the regulations.

Inspection

For security purposes, the company has the right to open packages and inspect any package delivered to our warehouse on your behalf.

Packages lost or damaged in transit to our warehouses

The company will not be responsible for any packages that are lost or damaged before their delivery to our warehouses. We are only responsible for packages that have been confirmed delivered to one of our warehouses and are in our possession. We may ask for additional documents as your proof of delivery is still subject to our investigation.

Return, Cancellation, and Refund

The company is not responsible for merchant errors such as damage during transit to Californila warehouse or errors with sizes, types, and categories. It is the customer's responsibility to contact and make necessary arrangements with the merchants at their own cost.

The company does not offer refunds for abandoned orders. If the customer's order is unclaimed for 60 days, it will be considered an abandoned order. The company has the right to dispose of, destroy, or donate these items.

Storage

Californila will store your packages free of charge for 30 calendar days from the date they are received. After 30 calendar days, the company will charge the customer a storage fee of PHP 50 per day for up to 30 days. 

After 60 days of unclaimed orders, the items will be considered abandoned orders. The company has the right to dispose of, destroy, or donate these items.

Unidentified Parcel

In some cases, we receive a parcel that can’t be identified due to inaccurate, missing, or incorrect information. The customer must contact the support number or email us to properly tag and assign to the right customer.

Failure to inform the company within 60 days will result in the parcel being considered an abandoned order. The company has the right to dispose of, destroy, or donate these items.

Indemnification 

You agree to indemnify, protect, defend, and hold harmless the company and its employees from and against all claims, damages, obligations, losses, liabilities, and causes of action of every type resulting from or arising out of these terms, the operation, use, or access to the site, or the provision of the services.

Force Majeure

The company is not liable for any delays, loss, or damage arising out of circumstances beyond our control, including but not limited to any act or omission by a person not employed or contracted by the company, acts of God, including but not limited to earthquakes, cyclones, storms, floods, fog, war, plane crashes, embargos, riots, or civil commotion, or causes not within the reasonable control of the company.
